My work in commercial and property law is extensive. Here are some examples of my most recent cases.”

  • Advising and representing (at mediation) a co-director/shareholder in a deadlocked company in relation to serious internal disputes involving alleged breaches of duty, pre-emption rights and the renewal of the company’s franchise with a prestige motor manufacturer.
  • Appointment as Counsel advising a Chartered Accountant acting as expert determiner in relation to the meaning and effect of complex Indemnity and Counter-Indemnity arrangements created after the disposal of a commercial property portfolio. This case also involved consideration of the effect of Section 18 of the Landlord & Tenant Act 1938.
  • Advising the corporate leaseholder of a race-horse training facility in relation to interference with quiet enjoyment. This case also involved a counterclaim for dilipidations and under Jervis v Harris and began with an application for an interim injunction against the landlord and related third parties.
  • Advising and representing a shareholder/director of a deadlocked company against an absentee member/co-director in a claim under Sections 994 and 306 Companies Act 2006.
  • Advising and representing a commercial consumer in a dispute with its supplier of electricity with regard to billing arrangements and charges. This case was resolved at mediation.
  • Advising 2 partners in a six-partner family farming business with regard to dissolution, accounting and the beneficial ownership of property and other assets used in the business under long-standing informal arrangements.
  • Advising and representing a director/shareholder/employee in relation to chancery proceedings for unfair prejudice and claims in the Employment Tribunal following summary dismissal for alleged gross misconduct.
  • Advising and representing a local authority petitioning creditor responding to a bankrupt’s application to annul a bankruptcy order made 4 years earlier where the Trustees costs of the administration were approaching £.100,000 at the date of the hearing.
  • Advising the directors of a company facing insolvency in the event of the threatened termination of a franchise agreement with regard to strategies for continuation of the business and in relation to possible proceedings for specific performance of the company’s option to renew.
  • Advising a disappointed beneficiary with regard to the possible assumption of responsibility by solicitors retained by Trustees of a family settlement.
  • Advising and representing 300 off-plan purchasers of residential apartments in a stalled development on their rights and remedies against the developer under the standard sale contracts.
  • Advising on and drafting a new memorandum and articles of association for a private health company limited by guarantee having charitable objects.
